charity: water Fundraising Contest Terms and Conditions

This document outlines the terms and conditions for participation in the charity: water Fundraising Contest. By participating in the Fundraiser, you agree to these terms and conditions. charity: water retains the right to change, modify or even cancel the Contest as it may deem appropriate in its sole judgment.

Eligibility :

The charity: water Fundraising Contest is open only to legal residents of the United States. Participants of ages 13-17 need parental consent to fundraise, and all must be 18 years or older by September 1 to win the “charity: water NYC Trip” or the “Trip to the Field”. Employees of charity: water, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers with a direct relationship with a staff member at charity: water (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the contest.

Contest period:

The contest begins on September 1, 2023, and ends on September 30, 2023 at 11:59 PM EST.

How to enter:

To participate in the contest, individuals must create a fundraising campaign on the charity: water website during the contest period. Fundraisers created on platforms other than the charity: water website are not eligible for this contest.

Prizes:

Participants can win merchandise prizes by reaching certain fundraising goals. charity: water reserves the right to substitute prizes of equal or greater value. The charity: water NYC Trip will be awarded to the top fundraiser based on total amount raised during the contest period. In the case of a tie between two or more fundraisers, the fundraiser with the greatest number of individual donations will be considered the winner. The contest winner will be invited to attend the November 30th, 2023 charity: water NYC event with a guest, with all expenses related to travel and accommodations covered by charity: water. Expenses are calculated in accordance with charity: water’s expense policy, including main cabin airfare, non-luxury hotels, transportation using a rideshare or taxi service, and a meal stipend of $80/day. Participants who have raised at least $1 during the contest period and/or active members of The Spring — Spring membership is not in a cancelled or paused state — are eligible to apply for the Trip to the Field. The Trip to the Field participant will be selected through a competitive application process. Prizes and trips are non-transferrable and no cash alternatives will be offered. Dates are subject to change.

Travel requirements:

The winner of the charity: water NYC trip must meet the standard identification requirements for domestic travel within the United States. The winner of the Trip to the Field must have a valid passport and all necessary vaccinations and health clearance for travel, and must pass a third-party background check. Winners must sign charity: water’s standard waiver of liability release prior to travel and a media release allowing us to take and use their image for promotional purposes.

Use of data:

By participating as a fundraiser you are consenting to charity: water collecting personal data about participants (including you) online, in accordance with its privacy policy. Please review charity: water's privacy policy on our website.  Furthermore, by participating in the fundraising contest you agree that we may publicize your participation (for example, in email communication, on social media, or on some type of leaderboard). charity: water will own all rights to publish and promote any applications submitted.

Disqualification and prize forfeiture:

charity: water reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the participation process or the operation of the contest, or to be in violation of these Official Rules. Such disqualified participants will forfeit all rights to any prizes awarded by charity: water. Furthermore, if a winner is unable to meet all obligations and requirements for the Trip to the Field (including, but not limited to, possessing a valid passport, having necessary vaccinations, or passing a background check), charity: water reserves the right to select another eligible participant.

Expenses and tax implications:

All expenses related to prizes, including travel and accommodations for the charity: water NYC trip and the Trip to the Field, are covered by charity: water within the limits of our expense policy. This includes airfare, hotel, ground transportation using a rideshare or taxi service, and a daily meal stipend. charity: water will not pay for alcohol, phone and internet charges, medical costs incurred as a result of travel or actions taken during any trip, or any other personal expenditures, including purchase of gifts for personal or other use. The fair market value of any prizes may be taxable. If you donate to your own campaign, the fair market value of any prizes earned may impact your charitable deduction. Winners are responsible for all taxes associated with the receipt of any prize and should consult with their own tax advisors about any potential tax implications. Prizes can be declined to avoid any tax liability.

Dispute resolution:

Except where prohibited, each participant agrees that any and all disputes, claims, and causes of action arising out of or connected with this contest, or any prize awarded, shall be resolved individually, in binding arbitration, in New York City without resort to any form of class action. 

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of charity: water in connection with the contest, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules.
